29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access; or, when such an extension was not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that would not deflect, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder: a) Job site, Lot 230 Cedar Creek Estates, Rostraver Township, PA: On or about November 9, 2023, during residential construction activities, the employer did not ensure that a ladder that was used to gain access to/egress from the top of the first floor was extended at least 3 feet above the landing surface, exposing employees to a fall of about 10 feet.

29 CFR 1926.20(b)(2): The employer did not ensure that frequent and regular inspections of the job sites, materials, and equipment were made by competent persons designated by the employer: a) Job site, Lot 230 Cedar Creek Estates, Rostraver Township, PA: On or about November 9, 2023, during residential construction activities, the employer did not ensure that a system was in place to identify and abate safety issues. Deficiencies noted during the inspection included, but were not limited to, failing to use safety glasses or hardhats where needed, not ensuring that proper warning labels were provided on ladders, not using fall protection systems/devices where necessary, not ensuring that an operator wore the seatbelt when operating a rough terrain forklift and failing to ensure that ladders were properly extended 3 feet above the landing platform.
