29 CFR 1910.134(e)(1): The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace:  a) Jobsite located at the 3500 Block of Kensington Ave, Philadelphia, Pennsylvania- On or about November 10th, 2023, to November 14th, 2023, the employer did not provide medical evaluations prior to requiring employees to use a respirator.  Employee used respirators such as but not limited to a 3M 6200 or 7500 half facepiece respirator with 3M 2091 and 6001 filters while performing bridge painting activities.

29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter:  a) Jobsite located at the 3500 Block of Kensington Ave, Philadelphia, Pennsylvania- On or about November 10th, 2023, to November 14th, 2023, the employer did not provide a fit test to all employees required to wear respirators, exposing them to respiratory hazards. The employer required employees to wear a respirator such as, but not limited to a 33M 6200 or 7500 half facepiece respirator with 3M 2091 and 6001 filters while performing bridge painting activities.

Employees are exposed to chemicals including but not limited to the following:  - Copper, Manganese, Iron as contained in the blasting grit. - Triethyoxysilyl Propylamine, Dibutyltin Dilaurate as contained in SHER-LOXANE 800 Polysiloxane (Part B)

Employees were performing bridge painting with one sign alerting traffic in the southbound lane of Road Work Ahead.
