OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  a) Machine Shop; On 7 November 2023 and at times prior to, the employer exposed employees to struck-by hazard in that fragments of Polyvinyl Chloride (PVC) plastic pipe used to transport compressed air at 80 psi could rupture in locations such as but not limited to air compressor shed and machine shop.

29 CFR  1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.   a) Machine Shop; On 7 November 2023 and prior to, the employer exposed employees to amputation hazards in that employees were allowed to operate Bantam Brake Press Model # B412 Serial # B9458 with unguarded pinch points.   b) Machine Shop; On 7 November 2023 and prior to, the employer exposed employees to amputation hazards in that employees were allowed to operate Pemserter Insertion Press Model # B49 Serial # 0170 with unguarded pinch points.   c) Machine Shop; On 7 November 2023 and prior to, the employer exposed employees to amputation hazards in that employees were allowed to operate National Sheet Metal Machine Model # NH5210 Serial # 889-286 with unguarded pinch points.
