29 CFR 1926.451(b)(1)(ii):The platform was not planked or decked as fully as possible and the remaining open space between the platform and the uprights exceeded 9.5 inches (24.1 cm): (a) North side of building - On or about November 20, 2023, the employer instructed his employees to work from the scaffold while the guard for the mast support was not in place where opening exceeded 9.5 inches exposing employees to fall hazards.

29 CFR 1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access. (a) North side of building - On or about November 20, 2023, the employer instructed his employees to gain access to the scaffold platform by climbing up the center mast as high as they can, then switch sides of the mast that is not build to be used as a ladder to climb through the opening in the platform exposing employees to fall hazards.
