29 CFR 1917.45(j)(1): Employees were hoisted by the load hoisting apparatus of a crane or derrick.  a) On or about November 21, 2023, at the cargo hold area of the SCF26017 vessel, employees engaged in marine terminal activities were hoisted by the load hoisting apparatus of a Komatsu PC750LC-7 excavator for access and egress of the work area, without any protection for being hoisted.

29 CFR 1917.50(a): The employer used a material handling device listed in 29 CFR 1917.50(c) before ascertaining that the device had been certificated, as evidenced by current and valid documents attesting to compliance with the requirements in 29 CFR 1917.50(b).  a) On or about November 21, 2023, at the dock of the worksite, the employer did not verify through written documentation that the shore-based material handling device, used for cargo handling operations, had been certified by an accredited agency prior to use of the equipment as required.
