29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated (a) Location - Jobsite On or about 10/05/2023, Employee was observed working in a Genie S-60X Aerial Lift approximately thirty (30) feet above the ground and was not protected via a body belt or lanyard.

29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Location - Jobsite On or about 10/05/2023, employees were not protected from falling while receiving construction supplies to perform construction activities from an elevated work area, exposing the employees to fall hazard in excess of thirty (30) or more feet above the ground level.
