29 CFR  1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a) On or about November 29, 2023, the employer did not ensure that an employee who was provided formal instruction, was also provided hands on training, evaluated, and certified to perform tasks and operate the equipment in a safe manner.  The employee operated the Yale AC Power  Electrical Stand up, Model ESC035AC, and Raymond ARC 7500 Model 750-DR32TT.    b)  On or about November 29, 2023, the employer did not ensure that an employee who was provided formal instruction, was also provided hands on training, evaluated, and certified to perform tasks and operate the equipment in a safe manner.  The employee operated the Yale AC Power  Electrical Stand up ESC035AC, Raymond ARC 7500 Model 750-DR32TT and Electric pallet jacks.    c)  On or about November 29, 2023, the employer did not ensure that an employee who was provided formal instruction, was also provided hands on training, evaluated, and certified to perform tasks and operate the equipment in a safe manner.  The employee operated the Raymond 5500 Standup Electric Order Picker Forklift.  No abatement certification or documentation is required for this item.

29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l), containing information including the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:  a) On or about November 29, 2023, the employer did not certify that employees were trained and evaluated on the forklift prior to permitting employees to operate equipment. An employee operated the Yale AC Power  Electrical Stand up ESC035AC, and Raymond ARC 7500 Model 750-DR32TT.  No abatement certification or documentation is required for this item.

29 CFR  1910.178(l)(4)(ii)(D):Refresher training in relevant topics was not provided to the operator when the operator was assigned to drive a different type of truck:  a) On or about March 7, 2024, the employer did not ensure that an employee  was assigned to operate the Raymond  5500 Standup Electric Order Picker Forklift Model 550-OPC30TT but certification indicated that the employee was evaluated on a Raymond 8510 rider pallet jack.  b) On or about March 7, 2024, the employer did not ensure that an employee was assigned to drive a different type of powered industrial vehicle. An employee was assigned to operated the Raymond ARC 7500 Standup Forklift Model 750-20-AC81861 but his certification indicated he was evaluated on a Raymond 8510 rider pallet jack.  No abatement certification or documentation is required for this item.
