29 CFR 1926.302(b)(3): All pneumatically driven nailers, staplers, and other similar equipment provided with automatic fastener feed, which operate at more than 100 p.s.i. pressure at the tool did not have a safety device on the muzzle to prevent the tool from ejecting fasteners, unless the muzzle is in contact with the work surface:  a) Homesite # 176; On or about November 29, 2023, and times prior, the employer exposed employees to struck by hazards, in that the employer did not ensure that Metabo (NR38AK C3490550) pneumatic nail gun was equipped with functioning safety contact tip where employees used the nail guns to fabricate wall frames from 2-inch by 4-inch lumber stock.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Homesite # 176; On or about November 29, 2023, and at times prior, employer exposed employees to fall hazards, in that the employer did not ensure that the employees were wearing personal fall arrest systems when conducting framing activities on the second story approximately 10 foot 3 inches from the ground level.
