29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  a) At the establishment located at N3545 County Road EE, Waupun, Wisconsin; the employer did not evaluate each powered industrial truck operator's performance at least once every three years to ensure they had the knowledge and skill to operate safely, exposing employees to struck-by hazards. On or about October 31, 2023, an employee operating a sit-down forklift that was not reevaluated within the past three years, drove up to a Line 3 employee standing in front of a fixed object, striking the employee.

29 CFR  1910.178(m)(1): Trucks shall not be driven up to anyone standing in front of a bench or other fixed object.  a) At the establishment located at N3545 County Road EE, Waupun, Wisconsin; the employer did not ensure that an employee operating a sit-down forklift did not drive up to anyone stranding in front of another fixed object, exposing an employee to struck by hazards. On or about October 31, 2023, an employee operating a sit-down forklift drove up to a Line 3 employee standing in front of a fixed object, striking the employee.
