29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Splash City, Inc. at 1421 West 44th Place, Sioux Falls, SD 57105: On or about and at times prior to December 7, 2023, the employer did not ensure that employees were trained on how to operate powered industrial trucks prior to operating the Toyota Electric Forklift Truck, Model: 5FBE15. This condition exposed employees to injuries associated with improper powered industrial truck operations.  (b)Splash City, Inc. at 1421 West 44th Place, Sioux Falls, SD 57105: On or about and at times prior to December 7, 2023, the employer did not ensure that employees were trained on how to operate powered industrial trucks  prior to operating the Komatsu Forklift, Model: FG20CLP-12. This condition exposed employees to injuries associated with improper powered industrial truck operations.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  (a)Splash City, Inc. at 1421 West 44th Place, Sioux Falls, SD 57105: On or about and at times prior to December 7, 2023, the employer did not ensure that custom forklift extensions had a data plate attached to it when being used with the Toyota Electric Forklift, Model: 5FBE15.  This condition exposed employees to injuries associated with improper powered industrial truck operations/loading.  (b)Splash City, Inc. at 1421 West 44th Place, Sioux Falls, SD 57105: On or about and at times prior to December 7, 2023, the employer did not ensure that custom forklift extensions had a data plate attached to it when being used with the Komatsu Forklift Model: FG20CLP-12.
