OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to Struck-by/Caught between hazards associated with damage to the structural components of storage rack systems.  a.) Wavepoint Cold Storage DBA Wavepoint 3PL, located at 2100 Pittsburgh Ave, Erie, PA 16502, on or about 12/12/2023 and times prior thereto: Various legs on storage racks that are attached to the ground in the cooler/freezer "A" were damaged.

29 CFR  1910.145(e)(2):The wording of signs was not easily read and concise.  a.) Wavepoint Cold Storage DBA Wavepoint 3PL, located at 2100 Pittsburgh Ave, Erie, PA 16502, on or about 12/12/2023 and times prior thereto; safety signs and safety instruction labels attached to equipment were not legible due to messages being worn off. Equipment includes but is not limited to the Toyota electric forklift truck (Model: 7FBCU18 / Serial: 67282).  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
