29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  a) Lot 11, on December 8th, 2023, the employer failed to instruct each employee in the avoidance of unsafe conditions due to no training being provided to the telescopic forklift operator when hoisting trusses to be placed on roof.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Lot 11 at the Enclave at Brookstone, An employee conducting wood framing operations on residential trusses was not protected from an approximate 19 feet, 4 inch fall hazard to the ground below, on or about December 8, 2023.  b) Lot 11 at the Enclave at Brookstone, An employee conducting wood framing operations on was not protected from an approximate 10 feet, 3 inch fall hazard to the ground below while working on a platform, on or about December 8, 2023.  c) Lot 9 at the Enclave at Brookstone, An employee conducting wood framing operations on was not protected from an approximate 10 feet, 3 inch fall hazard to the ground below while working on a platform, on or about December 8, 2023.  d) Lot 7 at the Enclave at Brookstone, An employee conducting wood framing operations on was not protected from an approximate 19 feet, 4 inch fall hazard to the ground below while working on a platform, on or about December 8, 2023.

29 CFR 1904.40(a): The employer did not provide an authorized government representative the records within the four business hours.  a) New townhome construction located on Lot #11 at 180 Enclave at Brookstone.  On or about December 08, 2023, the employer did not provide the OSHA 300 logs and the OSHA 300A forms to the CSHO within 4 hours of request.
