29 CFR 1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a) On or before 12/14/2023 the employer did not ensure that employees utilizing forklifts were conducting proper examinations to ensure safe operations of the PIVs, in that the data plate for the Towmotor V250 was unreadable.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a) On or about 12/14/2023 the employer did not ensure that employees required to operate PIVs had successfully completed formal classroom as well as practical training prior to operating PIVs in-order to ensure safe operations.
