29 CFR 1910.28  (b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28  On or about December 13, 2023 at Foot Locker Retail, Inc. on 250 Granite Street, Ste 1077A, Braintree, MA 02184, employees were exposed to an unprotected edge that was 8 feet 7 inches from the ground while accessing stored shoe boxes where there was no fall protection system in place.

29 CFR  1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.  On or about December 13, 2023 at Foot Locker Retail, Inc. on 250 Granite Street, Ste 1077A, Braintree, MA 02184, employees were not be able to easily exit the facility where the exit routes were not kept free and unobstructed due to boxes that were stored on the floor.  Foot Locker Retail, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.37(a)(3), which was contained in OSHA inspection number 1659012 , citation number 1, item number 2 and was affirmed as a final order on August 15, 2023, with respect to a workplace located at 514 Stanton Christiana Road, Newark, DE 19702 .
