Whenever any sling is used, the following practices shall be observed: a.)1910.184(c)(1):Slings that are damaged or defective shall not be used. b.)1910.184(c)(9) All employees shall be kept clear of loads about to be lifted and of suspended loads. c.)1910.184(c)(14) Employers must not use slings without affixed and legible identification markings. On or about December 19, 2023 the employer did not ensure that safe operating practices were being used in that on the affixed alloy steel sling in use there was no legible marking on the alloy steel chains, employees were not clear of loads while in operation, and that defective slings were being used, in that identification tags were missing on the slings.

29 CFR 1910.184(d):Inspections. Each day before being used, the sling and all fastenings and attachments shall be inspected for damage or defects by a competent person designated by the employer. Additional inspections shall be performed during sling use, where service conditions warrant. Damaged or defective slings shall be immediately removed from service. On or about December 19.2023, the employer did not ensure that the chain and it's attachment on the ABUS 10 ton EMH trolley/hoist had been inspected daily by a competent person prior to use.

(e)(3)(i) In addition to the inspection required by paragraph (d) of this section, a thorough periodic inspection of alloy steel chain slings in use shall be made on a regular basis, to be determined on the basis of (e)(3)(i)(A)frequency of sling use; (e)(3)(i)(B)severity of service conditions; (e)(3)(i)(C)nature of lifts being made; and (e)(3)(i)(D)experience gained on the service life of slings used in similar circumstances. Such inspections shall in no event be at intervals greater than once every 12 months. On or about December 19, 2023 the employer did not ensure that sling inspections were being used in that periodic inspections were being made by a competent person and that a inspection record was being maintained to identify the frequency of use, severity of service conditions, nature of lifts being made, and the most recent month each alloy steel chain sling was thoroughly inspected.
