OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  a. On or about November 15, 2023, Capstone Property Management located at 8864 United Lane, Athens, OH 45701, did not ensure personnel were prohibited from lifting employees in the bucket of a Caterpillar 303.5 mini hydraulic excavator and lowered into an open trench. The following condition exposes employees to fall and struck-by hazards.

29 CFR  1926.651(h)(1):Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline.  a.  Capstone Property Management located at 8864 United Lane, Athens, OH 45701: On or about December 22, 2023, the employer failed to protect an employee installing a storm drainage line in a trench that had over 1 foot of water accumulated in which the employee was working. There were no adequate precautions in place to protect the employee from water accumulation thereby exposing the employee to caught-between and/or struck-by hazards associated with trench collapse.

29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.  a.  Capstone Property Management located at 8864 United Lane, Athens, OH 45701: On or about December 22, 2023 and at times prior, the employer did not ensure daily inspections of trenches were made by a competent person.  Employees worked in a trench at depths between four feet, six inches and six feet with an accumulation of water without any protective system in place to prevent collapse. Inspections were not performed by a competent person to determine protective measures needed to work in trenches with these conditions. The following condition exposed employees to struck-by and caught-in hazards.

29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  a.  Capstone Property Management located at 8864 United Lane, Athens, OH 45701: On or about December 22, 2023 and at times prior, the employer did not ensure employees were protected from cave-ins by a protective system while performing work in a trench that was between four feet, six inches and six feet in depth. Employees worked in the trench with an accumulation of water performing sewer tie-in and storm drainage installation work without any means of cave-in protection in place. The following condition exposed employees to struck-by/caught-in hazards.
