29 CFR  1910.134(c)(1):  In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  On or about December 28, 2024; at a facility located at 307 Forest Avenue in Sheboygan Falls, WI; the employer did not establish and implement a written respiratory protection program when employees were required to wear respirators while working with chemicals such as, but not limited to formaldehyde and sulfuric acid.

29 CFR  1910.134(d)(1)(iii):  The employer shall identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH:  On or about December 28, 2023, at a facility located at 307 Forest Avenue in Sheboygan Falls, WI; the employer did not evaluate respiratory hazards in the workplace when employees were required to wear respirators while working with chemicals such as, but not limited to formaldehyde and sulfuric acid. The employer did not determine a reasonable estimate of employees' exposures to during formaldehyde transfers and LQA chemical mixing (containing in part, sulfuric acid).

29 CFR  1910.1048(d)(1)(i):  Each employer who has a workplace covered by this standard shall monitor employees to determine their exposure to formaldehyde:  On or about December 28, 2023, at a facility located at 307 Forest Avenue in Sheboygan Falls, WI; the employer did not monitor employee to determine their personal exposures to formaldehyde while employees transferred and assisted in transferring formaldehyde between the storage truck and delivery truck tanks.
