OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and/or crushed-by hazards.   On December 20, 2023 at the Waipio Peninsula Trestle: A Magswitch CE6600 cordless electronic magnetic lifter was used to lift material that exceeded the maximum length for non-cylindrical loads and did not achieve maximum adhesive force based on material width and thickness. Employees were exposed to struck by and crushed by hazards.

1926.251(a)(1) Rigging equipment for material handling shall be inspected prior to use on each shift and as necessary during its use to ensure that it is safe.  On December 20, 2023, at the Waipio Peninsula Trestle: A Magswitch CE6600 cordless electronic magnetic lifter was used to lift an I-Beam without being inspected during its use to ensure that it was safe.
