29 CFR 1926.501(b)(13) Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  89 Davis Hill Rd, Paxton, MA:  On December 15, 2023, multiple employees were exposed to falls of greater than nine feet when they delivered two laundry appliances near the unprotected edge of a second floor landing that was under construction.  On December 15, 2023, an employee delivering the first appliance was hospitalized after falling from that unprotected second floor landing edge.  Later on the day of the injury, two other delivery employees walked by the same fall hazard twice when delivering the second appliance.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: 89 Davis Hill Rd, Paxton, MA: On and before December 28, 2023, the employer had not trained each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.   On December 15, 2023, multiple untrained employees were exposed to falls of greater than nine feet when they delivered two laundry appliances near the unprotected edge of a second-floor landing that was under construction. On December 15, 2023, an employee delivering the first appliance was hospitalized after falling from that unprotected second floor landing edge.  Later on the day of the injury, two other delivery employees walked by that same fall hazard twice when delivering the second appliance.  *Abatement Notes: The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training. *Abatement notes are intended only to provide clarity regarding existing requirements under the law or agency policies. Abatement notes do not create (or diminish) legal obligations under the Occupational Safety and Health Act.
