29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a). Site: 88-06 161 Street, Jamaica, NY 11432. On or about January 3, 2024, employees installing a canopy from a platform edge approximately 12-feet from the ground level without a personnel fall arrest system were exposed to a fall hazard.    Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a). Site: 88-06 161 Street, Jamaica, NY 11432. On or about January 03, 2024, employees installing a canopy approximately 12-feet from the lower level were not trained to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  Abatement certification is required pursuant to 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.   a). Site:88-06 161 Street, Jamaica, NY 11432. On or about January 03, 2024, employees using a step ladder to access a working platform were exposes to fall hazards as the top cage of the ladder was below the working platform or point of access.    Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
