OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were operating forklifts without utilizing the seat belts present.  At the worksite located at 9311 Troost Ave Ste 300, Kansas City, MO 64131: Employees operating forklifts in the warehouse were exposed to a struck by and/or crushing hazard in the event the operator is ejected from the forklift following a circumstance where the forklift tips-over or collides with another forklift or equipment. Employees are engaged in operating Toyota Sit down powered industrial trucks in the warehouse every day.  AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS:   (a) Ensure that employees are utilizing an operator's restraint system (seatbelt) as recommended by the Operator's Manual for the Toyota Forklift, model 8FBE20U, pg. 30 which states "Always wear your seat belt when driving the vehicle. The vehicle can tip over if operated improperly. To protect operators from the risk of serious injury or death in the event of a tip over, it is best to be held securely in the seat. The seat and seat belt will help to keep you safely within the vehicle and operator's compartment."  In addition,  ASME B56.1-1993, Part III, Section 7.39 (a) states " "Counterbalanced, center control, high lift trucks that have a sit-down, non-elevating operator position shall have a restraint device, system, or enclosure that is intended to assist the operator in reducing the risk of entrapment of the operator's head and/or torso between the truck and ground in the event of a tip-over."  (b) Ensure employees are operating the forklift in accordance with the company PIT program pg. 37 which states "always wear your seatbelt".  (c) Develop, implement, and communicate to employees a progressive disciplinary action program and procedures to ensuring employees follow safety protocols such as wearing a seat belt while operating these vehicles.   (d) Review the company's current forklift training program to ensure it addresses the struck-by, roll over and caught between hazards related to operating a forklift and apply recommended safety measures to ensure safe operation of the vehicle.  (e) Have management officials conduct periodic unannounced observations of forklift use while operated by a certified operator.

At the workplace located at 9311 Troost Ave suite 300, Kansas City, MO 64131, employees were exposed to struck-by, crushed-by, and ejection hazards, in that the employer did not ensure that forklifts were being inspected daily for defects before use. Instead, the employer was inspecting forklifts on a monthly basis
