OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: in that employees were exposed to struck-by and crushing hazards. a. Interstate 280 Westbound, Exit 13, Bridge shoulder, Newark, NJ On or about January 10, 2024, employees of Joseph M. Sanzari Inc. were exposed to struck-by and/or crushing hazards while working near and around a Caterpillar 321 track excavator, S/N MPG00535 while removing the concrete parapet of the bridge. Employees were working in the operator's blind spot, in a narrowed work zone where the configuration of the work area did not allow for the swinging of the cab and the excavator was limited to being operated only in forward and reverse.

29 CFR 1926.56(a): While work was in progress, construction areas, ramps, runways, corridors, offices, shops or storage areas were not lighted to the minimum illumination intensities as listed in Table D-3 of 29 CFR 1926.56: a. Interstate 280 Westbound, Exit 13, Bridge shoulder, Newark, NJ During removal of parapet wall sections, the work area was illuminated to an intensity of less than 5 foot candles, exposing employees to struck-by and crush injury hazards from a Caterpillar 321 track excavator operating in the area. Violation occurred on or about January 10, 2024
