OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in the following instances: 1. The employer did not have a written respiratory program implemented while requiring employees to wear a respirator when spraying hydroponic crops with SaniDate 5.0, a sanitizer and disinfectant for commercial use. 2. The employer did not have employees that were wearing respirators medically evaluated as identified in standard 1910.134(c)(1)(ii). 3. The employer did not have employees wearing respirators fit tested to ensure the respirator fit properly and snugly as identified in standard 1910.134 (c)(1)(iii).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: Agriculture Reference: 1928.21(a)(5) Employees at the Kansas Natural Remedies jobsite were exposed on a daily basis to over 60 different chemical types, ranging from simple cleaners to caustic and highly flammable chemicals without any understanding of what hazards they were being exposed.
