29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Welding Area: On or about January 11, 2024: an employee welding and grinding mild steel was exposed to continuous noise at a level of 200.1% dose (equivalent to a TWA of 95 dBa) which is approximately 5 times the action level for a 10-hour workday of 40% dose (equivalent to a TWA of 83.4dBa) and the employer did not administer a continuing, effective hearing conservation program. Sample taken over 547 minutes. b) Welding Area: On or about January 11, 2024: an employee welding and grinding stainless steel was exposed to continuous noise at a level of 69.7% dose (equivalent to a TWA of 87.3 dBa) which is approximately 1.74 times the action level for a 10-hour workday of 40% dose (equivalent to a TWA of 83.4dBa) and the employer did not administer a continuing, effective hearing conservation program.
