29 CFR  1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck.  On or about January 12, 2024, employees were exposed to struck-by hazards when employees in the facility were required to operate forklifts while moving material without having been trained and evaluated to ensure they could do so safely.

On or about January 12, 2024, throughout the facility where employees were using forklifts that were put into service without first being examined to check unsafe conditions:  Instance 1- the Caterpillar Forklift was not inspected daily before put into service at Houston Metal Sawing, LLC.   Instance 2- the Nissan Forklift was not inspected daily before put into service at Houston Metal Sawing, LLC.

29 CFR  1910.178(l)(3)(ii)(H): Employees shall be trained not to use gas-powered forklifts in closed environments and other areas where insufficient ventilation or poor vehicle maintenance could cause a buildup or carbon monoxide or diesel exhaust.    On or about January 12, 2024, employees were exposed to carbon monoxide poisoning when a propane powered forklift was being used inside the shop with no ventilation, or open doors.

On or about January 12, 2024:   Instance 1- In the machine shop, employees were exposed to struck-by hazards while using a 60" Hem Bandsaw that did not have a point of operation guard on it.   Instance 2- In the machine shop, employees were exposed to struck-by hazards while using a 40" Hem Bandsaw that did not have a point of operation guard on it.   Instance 3- In the machine shop, employees were exposed to struck-by hazards while using a Velox 1080 Bandsaw that did not have a point of operation guard on it.   Instance 4- In the machine shop, employees were exposed to struck-by hazards while using a 560 Velox- 1 Bandsaw that did not have a point of operation guard on it.   Instance 5- In the machine shop, employees were exposed to struck-by hazards while using a 560 Velox- 2 Bandsaw that did not have a point of operation guard on it.   Instance 6- In the machine shop, employees were exposed to struck-by hazards while using a 530 Velox- 1 Bandsaw that did not have a point of operation guard on it.   Instance 7- In the machine shop, employees were exposed to struck-by hazards while using a 530 Velox- 2 Bandsaw that did not have a point of operation guard on it.   Instance 8- In the machine shop, employees were exposed to struck-by hazards while using a 460 Lexas Bandsaw that did not have a point of operation guard on it.   Instance 9- In the machine shop, employees were exposed to struck-by hazards while using a 330 Velox- 1 Bandsaw that did not have a point of operation guard on it.   Instance 10- In the machine shop, employees were exposed to struck-by hazards while using a 330 Velox- 2 Bandsaw that did not have a point of operation guard on it.   Instance 11- In the machine shop, employees were exposed to struck-by hazards while using a 330 Velox- 3 Bandsaw that did not have a point of operation guard on it.   Instance 12- In the machine shop, employees were exposed to struck-by hazards while using a 330 Velox- 4 Bandsaw that did not have a point of operation guard on it.   Instance 13- In the machine shop, employees were exposed to struck-by hazards while using a 330 Velox- 5 Bandsaw that did not have a point of operation guard on it.   Instance 14- In the machine shop, employees were exposed to struck-by hazards while using a 330 Velox- 6 Bandsaw that did not have a point of operation guard on it.   Instance 15- In the machine shop, employees were exposed to struck-by hazards while using a Trajan 300 Bandsaw that did not have a point of operation guard on it.   Instance 16- In the machine shop, employees were exposed to struck-by hazards while using a V-200 Hem Bandsaw that did not have a point of operation guard on it.
