On or about January 15, 2024, the employer failed to provide training in accordance with 29 CFR 1910.120(q)(6)(i) through (q)(6)(v) for employees who participated in or were expected to participate in emergency response when employees were required to respond to a release of a hazardous substance with potential health effects, including but not limited to, hydrochloric acid.

29 CFR  1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about January 15, 2024, the employer did not ensure employees performing maintenance on the piping system of a hydrochloric acid tank used appropriate eye protection such as chemical goggles with face shield when exposed to hydrochloric acid splashes.

29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function.  On or about January 15, 2024, the employer did not ensure employees required to wear a full-face respirator while neutralizing a hydrochloric acid spill did not have facial hair that came between the sealing surface of the facepiece and face.
