OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees,  in that employees were exposed to struck-by and crush-by hazards.  a) On or about 1/17/2023 at the site located at 1215 State Fair Boulevard, Syracuse, NY: Employees were exposed to being struck-by and/or crushed by pallet racks. Among other methods, one feasible and acceptable method to correct the hazards noted are to: 1)	Follow the manufacturer installation instructions by bolting racking to the floor. 2)	Conform with the American National Standards Institute (ANSI) standard MH16.1-2012, Specifications for the Design, Testing and Utilization of Industrial Steel Storage Racks, sections 1.4.7 , 7.1, and 7.3 which requires anchor of racking systems.        Abatement certification is required.

Employees exposed to falls of up to 16ft.  b) On or about 1/17/2023 at the site located at 1215 State Fair Boulevard, Syracuse, NY: Employees working on the second tier of pallet racks in the secondary storage buildings were not utilizing fall protection were exposed to a fall distance of approximately 7 feet and 3 inches.  Abatement certification is required.
