29 CFR  1910.212(a)(1): One or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation and rotating parts:   a) 852 Boardwalk, Ocean City, NJ - The employer allowed employee to operate the Hobart 80 Quart Mixer, Model # L-800, top RPM of 1,725, with on mixer guard in place during mixing operations, thus exposing employee to amputation hazards. This condition was observed on or about January 18, 2024.  NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR  1904.4(a): The employer did not record on the OSHA Form 300 or equivalent each work-related fatality, injury, or illness case that resulted in the general recording criteria:   a) 852 Boardwalk, Ocean City, NJ - The employer does not maintain OSHA 300 injury/illness logs for fatalities, injuries or illnesses that may have occurred at this site in which the employer is required to record these instances. This condition was noted on or about January 18, 2024.  NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
