29 CFR 1910.178(l)(1)(i):The employer did not ensure that each Powered Industrial Truck (PIT) operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a)Mi San Juditas Construction at 5400 South Marion Road, Sioux Falls, SD 57106: On or about and at times prior to January 25, 2024, the employer did not ensure that PIT operators were competent to operate the Ingersoll Rand, Model VR-642C telehandler, safely by a successful completion of a training program. This condition exposed employees to struck-by hazards associated with improper forklift operations. (b)Mi San Juditas Construction at 5400 South Marion Road, Sioux Falls, SD 57106: On or about and at times prior to January 25, 2024, the employer did not ensure that PIT operators were competent to operate the Ingersoll Rand, VR-1056D telehandler, safely by a successful completion of a training program. This condition exposed employees to struck-by hazards associated with improper forklift operations.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. (a)Mi San Juditas Construction at 5400 South Marion Road, Sioux Falls, SD 57106: On or about and at times prior to January 25, 2024, the employer did not ensure that all employees wore appropriate eye and face protection while operating pneumatic nail guns conducting residential framing operations. This condition exposed employees to struck-by hazards associated flying debris.

29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the forklift mast: (a)Mi San Juditas Construction, at 5400 South Marion Road, Sioux Falls, SD 57106: On or about and at times prior to January 25, 2024, the exposing employer did not ensure that the elevated platform was properly attached to the Ingersoll Rand Telehandler, Model VR-642C in that, securement chains were not utilized to secure the basket to the mast. This condition exposed employees to fall hazards and crushing hazards associated with the platform separating from the mast of the forklift. (b)Mi San Juditas Construction, at 5400 South Marion Road, Sioux Falls, SD 57106: On or about and at times prior to January 25, 2024, the exposing employer did not ensure that the elevated platform was properly attached to the Ingersoll Rand Telehandler, Model VR-1056D in that, securement chains were not utilized to secure the basket to the mast. This condition exposed employees to fall hazards and crushing hazards associated with the platform separating from the mast of the forklift.
