29 CFR 1910.23(c)(8): The employer did not ensure that the cap (if equipped) and top step of a stepladder are not used as steps. a) The Lane Drug Company dba Rite Aid Pharmacy (#02373) located at 21991 Ohio 51, Genoa, Ohio, 43430: On or about January 26, 2024, the employer failed to ensure that employees did not utilize the top steps of the portable ladders while performing activities such as, but not limited to, accessing the loft area in the storage room which exposed employees to falls approximately eight feet or greater to the concrete floor below.

29 CFR 1910.23(c)(11): The employer did not ensure that portable ladders used to gain access to an upper landing surface that have side rails that extend at least 3 feet (0.9 m) above the upper landing surface. a) The Lane Drug Company dba Rite Aid Pharmacy (#02373) located at 21991 Ohio 51, Genoa, Ohio, 43430: On or about January 26, 2024, the employer failed to ensure employees were provided portable ladders with side rails that extend at least three feet above the upper landing surface. Employees tasked with accessing the loft area in the storage room (8 ft from the level below) by way of a 10 ft A-framed ladder were exposed to falls approximately eight feet or greater to the concrete floor below.

Employees placing boxes and accessing inventory from this location were exposed to falls of approximately eight feet to the concrete floor below.
