29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.   29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):           a) On or about January 29, 2024, the employer engaged in the operation of an all-terrain forklift without ensuring competency to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation.   No abatement certification or documentation required for this violation.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a) On or about January 29, 2024, employees were exposed to the hazard of falling approximately fifty feet (50 feet) while walking/working along the unprotected edges of a balcony on a five story (5 story) building.    No abatement certification or documentation required for this violation.
