29 CFR  1926.1431(k)(10)(i): Except over water, employees occupying the personnel platform were  not provided or utilize a personal fall arrest system. The system must be attached to a structural member within the personnel platform. When working over or near water, the requirements of § 1926.106 apply:  (a) On or about and at times prior to January 22, 2024, the employer did not provide or enforce the use of a personal fall arrest system of employees being hoisted from a crane suspending a working platform.  The platform shifted and tipped vertically, resulting in an employee and the working platform falling 20 feet, causing serious injury to the employee.
