29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   (a)  Gas station canopy - On or about January 31, 2024, the employer exposed employees to a fall hazard in that inadequate fall protection was used while framing the edge of a gas station canopy.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access.  (a)   Gas station canopy - On or about On January 31, 2024, the employer exposed employees to a fall hazard in that employees were exposed to a fall when the scissors lift platform was placed approximately 4 ft below the canopy access point.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  (a)  Gas station canopy - On or about On January 31, 2024, the employer exposed employees to struck-by hazards in that a forklift was not used in accordance with ANSI B56-1969. The employer did not ensure safe operation of an industrial lift truck in that the forklift was left elevated and unattended.
