29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) Sunnyside Care Center, LLC, 700 Collamer Rd, East Syracuse, NY 13057.  On or about January 25, 2024, the employer did not provide medical evaluations to an employee who was required to wear N95 filtering facepiece respirators, including but not limited to Makrite 9500-N95S and Makrite Sekura - N95 Disposable Respirator, when working with patients exposed to COVID-19.  (b) Sunnyside Care Center, LLC, 700 Collamer Rd, East Syracuse, NY 13057.  On or about February 2, 2024, the employer did not provide medical evaluations to employees who are required to wear N95 filtering facepiece respirators, including but not limited to Makrite 9500-N95S and Makrite Sekura - N95 Disposable Respirator, when working with patients exposed to COVID-19.   Abatement certification is required.

On or about January 25, 2024, the employer did not provide fit tests to an employee who was required to wear N95 filtering facepiece respirators, including but not limited to Makrite 9500-N95S and Makrite Sekura - N95 Disposable Respirator, when working with patients exposed to COVID-19. 29 CFR  1904.29(b)(1): The employer did not provide the required injury or illness descriptions on the Log of Work-Related Injuries and Illnesses, OSHA Form 300, in the detail provided in the form and the instructions contained therein:   a) Sunnyside Care Center, LLC, 700 Collamer Rd, East Syracuse, NY 13057 on or about  November 10, 2023, the employer did not accurately complete the OSHA Form 300 to the level of detail required by the standard. The log is missing case numbers, had inadequate injury/illness descriptions, and did not accurately classify cases in columns (G) through (L).  Abatement certification is required.
