OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and caught between hazards while attempting to erect a wood framed wall.  Jobsite, Building to be #6 Josiahs Path: On or about February 2, 2024, employees were exposed to struck by and caught between hazards while attempting to erect a wood framed wall which suffered a structural failure during erection and fell onto two employees.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501.  Jobsite: On or about February, 2, 2024, employees were exposed to falls over 6 feet.  1) Employees were exposed to fall hazards due to the improper covering of a stair hole in the decking. 2) Employees were exposed to fall hazards due to floor hole covering not being secured in place. 3) Employees were exposed to fall hazards due to lack of identifying markings on hole covers in walking working surfaces.

29 CFR  1926.1051(a):Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided:  Jobsite: On or about February 2, 2024, employees were exposed to fall hazards while accessing first floor working platform of residential dwelling under construction.  Evolution Pro Builder Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1051(a), which was contained in OSHA inspection number 1663061, citation number 1, item number 1a and was affirmed as a final order on January 9, 2024, with respect to a workplace located at 6 Haven Lane, Wayland, MA.
