Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. Located at 815 Centerbeam Ave, Plain City, OH 43064: On or about February 6, 2024, the employer did not ensure that an employee was protected from fall hazards of approximately 12 feet while installing subfloor boards onto the floor joists of the second story of an under construction residential house. b. Located at 815 Centerbeam Ave, Plain City, OH 43064: On or about February 6, 2024, the employer did not ensure that employees were protected from fall hazards of over 6 feet, due to an unguarded opening on an exterior side wall, when using portable ladders to access the second story of an under construction residential house.

As a result, employees were exposed to fall hazards.
