29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) New single-family residential structure located at 6240 Bennett Parkway, Cumming, GA 30040 (Lot 43 The Park at Bethelview subdivision), Roof: On or about 2/5/2024, the employer exposed employee to fall hazards of approximately 11-feet, 6- inches, to the lower ground level, in that a fall protection system was not provided or utilized while engaged in painting activities on a 2/12 pitched roof.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:   a) New single-family residential structure located at 6240 Bennett Parkway, Cumming, GA 30040 (Lot 43 The Park at Bethelview subdivision), Roof: On or about 2/5/2024, the employer exposed employee to fall hazards of approximately 11-feet, 6-inches, to the lower ground level, in that a fall protection system was not provided or utilized while performing painting operations on a 2/12 pitched roof, in that a training program was not in place for employees to recognize and properly minimize the fall hazards.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) New single-family residential structure located at 6240 Bennett Parkway, Cumming, GA 30040 (Lot 43 The Park at Bethelview subdivision), Front roof: On or about 2/5/2024, the employer exposed employee to fall hazards of approximately 11-feet,6- inches, to the lower ground level, in that the portable extension ladder used to access the upper work area did not have side rails extending at least three feet above the upper landing area.
