29 CFR  1910.134(c):Respiratory protection program. This paragraph requires the employer to develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use. The program must be administered by a suitably trained program administrator. In addition, certain program elements may be required for voluntary use to prevent potential hazards associated with the use of the respirator. The Small Entity Compliance Guide contains criteria for the selection of a program administrator and a sample program that meets the requirements of this paragraph. Copies of the Small Entity Compliance Guide will be available on or about April 8, 1998 from the Occupational Safety and Health Administration's Office of Publications, Room N 3101, 200 Constitution Avenue, NW, Washington, DC, 20210 (202-219-4667).  On or about January 25, 2024, at shop floor,  employees were exposed to undue physiological stress when wearing N-95 respirator while finishing marble without a written respiratory protection program that covers elements such as, but not limited to: respirator selection, medical evaluation, voluntary use, and training.

29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  On or about January 25, 2024, on shop floor, the employer did not developed a written hazard communication program for employee(s) working on marble finishing operation.

29 CFR  1910.1200(e)(1)(i): A list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,   On or about January 25, 2024, on shop floor, the employer did not have a chemical inventory list available for employees to reference to identify the appropriate safety data sheet, as employees worked with or around hazardous substances including, but not limited to, butanone while finishing marble.
