29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  On or about 02/13/2024, in the warehouse area of the establishment located at 2860 W. 3rd Court, Hialeah, Florida, an employee was exposed to an approximated 7-foot fall hazard after climbing a storage rack to retrieve merchandise without a means of all protection.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about 02/13/2024, in the warehouse area of the establishment located at 2860 W. 3rd Court, Hialeah, Florida, employees were exposed to struck-by hazards when employees were operating a forklift prior to the employer providing the operators with powered industrial truck (PIT) training.
