29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) (AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d)):  On 2/28/2024, and at times prior, at 8725 West State Road 78, Moore Haven Fl 33471, a powered industrial truck (Model 5042T4F, Serial Number D160111247) was operated by an employee who was not trained and evaluated, thus exposing employees to a struck by hazard.
