29 CFR 1926.1431(a): The use of equipment to hoist employees is prohibited except where the employer demonstrates that the erection, use, and dismantling of conventional means of reaching the work area, such as a personnel hoist, ladder, stairway, aerial lift, elevating work platform, or scaffold, would be more hazardous, or is not possible because of the project's structural design or worksite conditions. On or about 2/6/2024 and at times prior, at Building 2200, 5410 Double Eagle Circle, Ave Maria, Florida, an employee was exposed to a 9-foot fall hazard while standing on a precast concrete form being hoisted into position with a crane.
