29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle:  (a)Mereen-Johnson, LLC at 10 Park Lane, Webster, SD 57274: On or about and at times prior to February 28, 2024, the employer did not ensure guarding was in place on the Bridgeport EZ Trak CNC/Manual Mill, Drive Serial Number: 168551 within the Machine Shop Area.  This condition exposed employees to amputation hazards associated with the unguarded point of operation.  (b)Mereen-Johnson, LLC at 10 Park Lane, Webster, SD 57274: On or about and at times prior to February 28, 2024, the employer did not ensure guarding was in place on the Bridgeport EZ Trak CNC/Manual Mill, Drive Serial Number: 1943390 within the Machine Shop Area. This condition exposed employees to amputation hazards associated with the unguarded point of operation.  (c)Mereen-Johnson, LLC at 10 Park Lane, Webster, SD 57274: On or about and at times prior to February 28, 2024, the employer did not ensure guarding was in place on the Giddings & Lewis NumeriPath Vertical CNC Mill - 800 Control, model number 15V, Machine Number: 54-08 within the Machine Shop Area.  This condition exposed employees to amputation hazards associated with the unguarded point of operation.  (d)Mereen-Johnson, LLC at 10 Park Lane, Webster, SD 57274: On or about and at times prior to February 28, 2024, the employer did not ensure guarding was in place on the Series II Bridgeport Manual Mill, Serial Number 69954-2 within the Assembly Area.  This condition exposed employees to amputation hazards associated with the unguarded point of operation.  (e)Mereen-Johnson, LLC at 10 Park Lane, Webster, SD 57274: On or about and at times prior to February 28, 2024, the employer did not ensure guarding was in place on the Wilton Drill Press, Machine Number 5804 within the Assembly Area.  This condition exposed employees to amputation hazards associated with the unguarded point of operation.  (f)Mereen-Johnson, LLC at 10 Park Lane, Webster, SD 57274: On or about and at times prior to February 28, 2024, the employer did not ensure guarding was in place on the Central Machinery Floor Drill Press, Serial Number 366851838 within the Assembly Area.  This condition exposed employees to amputation hazards associated with the unguarded point of operation.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  (a)Mereen-Johnson, LLC at 10 Park Lane, Webster, SD 57274: On or about and at times prior to February 28, 2024, the employer did not ensure a periodic inspection was conducted at least annually to ensure that its lockout/tagout program was being followed and any deviations or inadequacies were identified. This condition exposed employees to amputation, crushing and shock hazards associated with an improperly locked out equipment.
