29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: On or about February 28th, 2024, employees engaged in the maintenance of press machines located at 314 Industrial Ave, Hartington, Nebraska 68739 were exposed to hazardous releases of energy including but not limited to electrical and hydraulic energy sources. The employer did not establish or implement a LOTO program that consisted of all the required elements of the LOTO program as defined by the standard.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about February 28th, 2024, employees engaged in maintenance and production operations located at 314 Industrial Ave, Hartington, Nebraska 68739 were exposed to hazardous chemicals in that the employer failed to develop a written Hazardous Communication Program that consisted of all the required elements. Instances of exposure include employees using the following chemicals in the performance of maintenance and production activities: i. 62 RP Spindle Lube - AMCOL Corporation ii. 767 Anti-Seize Lubricant, 1LB - Permatex iii. 2200 GT Charcool (M10) - AMCOL Corporation iv. 2200 LX Charcool (M1) - AMCOL Corporation v. Acetylene (dissolved) - Air Liquide vi. Brakeleen Brake Parts Cleaner 19oz - CRC Industries vii. Carbon dioxide (refrigerated) - Air Liquide viii. Engine Brite Heavy Duty Engine Degreaser ix. 29 CFR 1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about February 28th, 2024, employees engaged in maintenance and production operations located at 314 Industrial Ave, Hartington, Nebraska 68739 were exposed to hazardous chemicals. The employer failed to train employees on the hazards related to the chemicals they work with or which are in their work area.
