29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a)  On or about February 28, 2024, and at times prior, the employer did not provide a written respiratory protection program to employees who wore half-face respirators and N-95s in the workplace. The employee grinding on concrete wore a half-face respirator with P100 filters and the employee sanding outside wore an N95 (both mandatory); there was no written respiratory protection program that included worksite-specific procedures, training required, fit testing, maintenance and storage, medical evaluations, and the other requirements required in 1910.134(C)(1) exposing employees to physiological burdens. 29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a)  On or about February 28, 2024, and at times prior, the employer did not provide a medical evaluation to employees who wore half-face respirators and N-95s in the workplace. The employee grinding on concrete wore a half-face respirator with P100 filters and the employee sanding outside wore an N95; there were no medical evaluations before usage, exposing employees to physiological burdens. 29 CFR  1910.25(b)(1): 29 CFR 1910.25(b)(1): The employer did not ensure that handrails, stair rail systems, and guardrail systems are provided in accordance with � 1910.28.   a) On or about February 28, 2024, employees were exposed to fall hazards due to the lack of a stair railing on one side of the exterior stairs between the upper office and lower level buildings. The employer failed to ensure the open edge along the stairs was guarded in a way that employees would not fall at more than four feet in height. The employer did not ensure that each employee on a walking-working surface (e.g. stair rail system) with an unprotected side more than 4 feet above a lower level is protected from falling by guardrail systems.

29 CFR  1910.178(l)(4)(iii):An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  a) On or about February 28, 2024, and at times prior, employees were exposed to struck by and crush by hazards. The employer failed to ensure  Powered Industrial Truck operators were evaluated at least every three years. Employees utilize the forklifts  to move heavy concrete objects and other materials on the lot and throughout the facility.

29 CFR  1910.303(g)(1): Sufficient access and working space was not provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment:  a) On or about February 28, 2024, and at times prior, the employer failed to ensure the area in front of the electrical panel of the welding shop was clear. Metal structures and other heavy objects were blocking access to the panel, preventing rapid emergency shut downs from occurring.

29 CFR  1910.1053(d)(4): The employer did not reassess exposures whenever a change in the production, process, control equipment, personnel, or work practices was reasonably expected to result in new or additional exposures at or above the action level, or when the employer had reason to believe that new or additional exposures at or above the action level have occurred:   a)  On or about March 22, 2024, and at times prior the employer did not conduct exposure assessments for employees who may reasonably be expected to be exposed to respirable crystalline silica at or above the action level.  The grinder and water hose were a new addition to the employees' operations.
