29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied. On or about March 1, 2024, and times prior thereto at this workplace, employees conducted framing operations at this residential structure under construction, employees worked from a platform elevated greater than ten feet above a lower level by a rough terrain forklift and the platform was not attached to the forks and the forklift while occupied by employees.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about March 1, 2024, and times prior thereto at this workplace, employees conducted framing operations at this residential structure under construction, employees worked from a platform elevated greater than ten feet above a lower level by a rough terrain forklift and were not protected from falls by the use of personal fall arrest systems or guardrail system.

On or about March 1, 2024, and times prior thereto at this workplace, employees conducted framing operations at this residential structure under construction, employees worked from a platform elevated greater than ten feet above a lower level by a rough terrain forklift truck and platform. The rough terrain forklift truck operator was not trained and evaluated as required by paragraph 29 CFR 1910.178 (l) AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d).
