OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck by/against hazards:  a) On or about 06/09/2023, during the construction of the new Quicklees, located on Chili Avenue, in Rochester, New York, the employer did not enforce safety practices such as, but not limited to: conduct visual inspections of a scissor lift and follow the operating manual instructions for employees were working from a scissor lift (SkyJack SJ111 3219)  10 feet above lower levels. The scissor lift was not inspected or maintained to ensure the control panel was secured with the provided locking pin. Employees were exposed to struck by/against hazards due to an unsecured control console.    NO ABATEMENT CERTIFICATION REQUIRED
