29 CFR 1910.28(b)(3)(i):  The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D):  (a)Department of Health and Human Services 8HHIH8211 at 400 Soldier Creek Road, Rosebud, SD 57570: On or about and at times prior to March 8, 2024, the employer did not ensure employees working in proximity to the west ventilation chute in the penthouse were protected from fall hazards in that the perimeter of the chute did not include appropriate fall protection systems to prevent falls into the chute area. This condition exposed employees to fall hazards in excess of 4 feet below a lower level.

29 CFR 1910.305(b)(2)(i):Each outlet box in completed installations did not have a cover, faceplate, or fixture canopy:  (a)Department of Health and Human Services 8HHIH8211 at 400 Soldier Creek Road, Rosebud, SD 57570: On or about and at times prior to March 8, 2024,  the employer did not ensure that employees were protected from shock and burn hazards in that the water fountain outlet near room 1204 was missing a cover exposing energized conductors. This condition exposed employee to shock and burn hazards.
