29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) 317 N. Market St., Wilmington, DE 19801: On or about March 8, 2024, employees were not trained to recognize, avoid, and prevent potential cave-in and struck by hazards. Employees were exposed to cave-in and implement hazards in that the employer sent employees to the worksite without training to control or eliminate hazards. Three employees were injured as a result of a cave-in.

29 CFR 1926.703(b)(3): Erected shoring equipment was not inspected immediately prior to, during, and immediately after concrete placement: a) 317 N Market Street Wilmington, DE 19801: On or about March 8, 2024, employee worked with erected shoring located on the first floor of site that was not inspected immediately prior to and during the concrete pour. Employees performed tasks such as but not limited to concrete work above the first-floor level resulted in a building collapse and employee injury.
