OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from crush by hazards: Location: 215 Canal Street in Manchester, NH a) On or about March 12, 2024, an employee operating a 2023 Yanmar Vio17 excavator (Serial No. 011698) while digging trenches and moving debris was not protected from crush by hazards where the Roll Over Protective Structure (ROPS) was removed from the excavator prior to use. b) On or about March 12, 2024, an employee operating a 2023 Yanmar Vio17 excavator (Serial No. 011698) while digging trenches and moving debris was not protected from crush by hazards where the excavator became overloaded while moving material with the tracks in the narrow position.
