29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied. On or about March 8, 2024, and times prior thereto, employees conducted exterior siding installation operations from an job made elevated platform that was not attached to the mast or forks. Employees were exposed to fall greater than 25 feet from while working.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about March 8, 2024, and times prior thereto, employees conducted exterior siding installation at the height greater than 25 feet above a lower level from an elevated platform without a means of a fall protection system in place.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l). On or about March 8, 2024, and times prior thereto, the employer used a Lull rough terrain forklift to elevate workers and materials above 25 feet to conduct exterior siding installation by an operator not trained and certified by the employer to operate the equipment. This condition exposed employee to fall from height.
